These Terms and Conditions of Use relate to the Teacher Time Machine (TTM) website, https://teachertimemachine.com/, owned and administered by Teacher Time Machine Inc. These Terms of Use are intended to inform users about the services provided by TTM, and the rights and responsibilities of the parties involved. TTM is an online platform that uses artificial intelligence (AI) to create digital resources, lesson plans, and assessments for educators. Users of the TTM website agree to be bound by these Terms of Use. If you do not agree to the Terms of Use, do not use the TTM website. In this document, the following definitions apply: A. "Access" means a User's ability to view and download Original Works provided by and stored on the TTM website. B. "Derivative Works" means an expressive creation which includes major elements of a previously-generated Original Work, i.e., a separate, independent work which is based on an Original Work. C. "Fee" means the Fee paid by a User, including all associated taxes. D. "Metadata Standards" means the basic set of definitions given to all of the variables within a dataset, so that all downstream users interpreting the resulting Original Work share a common understanding of what the Original Work means. E. "Original Work" means a work created, in whole or in part, using at least one AI tool, and that is uploaded, generated, and/or accessed to and from the TTM website and all intellectual property rights therein. Original Works include all new digital information requested and generated by a User and all existing digital information in the Resource Library database, including any audio files, video files, image files, data tables, and metadata. F. "Personal Information" means personal profile information provided by the User in the creation of their TTM account including but not limited to their name, username, password, email address, phone number, mailing address, and school district/curriculum location. Personal Information does not include Original Works or Derivative Works. G. "Terms of Use" means these Terms and Conditions, including the Privacy Policy enclosed within. H. "Third Party Payment Software" means any application or software which operates to process transactions and support online money transfers between vendors, consumers, auction sites, and other commercial entities. I. "TTM" means Teacher Time Machine Inc., which owns and administers the TTM platform and website, its administrative team, and its associated software including online tools for storing, managing, processing, and sharing Data. This website is located at: https://teachertimemachine.com/. J. "User" means any individual, association, corporation, organization, or institution who has created an account on the TTM website, including a Basic User and/or a Pro User, as defined herein.
A. TTM is dedicated to encouraging the development of resources created for educators, at least in part, using one or more artificial intelligence (AI) tools. TTM serves as an online tool for receiving and processing digital information and translating the information to generate instructions for the AI tools, and to sharing the digital information, whether new or preexisting in a resource library, to a community of educators. It should be understood that TTM will host the website as an internet platform whereby users generate new and/or access existing AI-generated lesson plans in the form of Original Works tailored to their educational goals. B. TTM is strictly a hosting service and provides the infrastructure and organizational framework which allows Users to request and access AI-generated Original Work(s) from TTM. TTM is provided with supporting metadata sufficient to make sensible and informed decisions about data use and AI-generated content. Users must abide by these Metadata Standards when interpreting Original Works on TTM. C. Users acknowledge and understand that misinterpretation of Original Works may occur. While all reasonable efforts may be made to ensure the accuracy of data and associated Original Works, TTM makes no guarantee, representation or warranty relating to accuracy thereof.
A. In order to use TTM, Users must be 18 years old and are required to create an account and to log in. Users agree to provide truthful Personal Information during the account creation process. By creating an account, Users acknowledge and agree to these Terms of Use, the Privacy Policy, including any amendments from time to time. B. Users agree that TTM, or any of its associated representatives, may communicate with you, including by sending information, correspondence, and notices to you. These communications may be sent via email, messages, push notification, phone, or otherwise through the contact information associated with your account. C. TTM offers three types of user accounts: Free/Basic User, Pro User, District User. Unless otherwise agreed upon in writing by TTM, the following applies: Basic User: Basic Users can create up to ten (10) Original Works at no charge. Pro User: Pro Users have unlimited access to create, view, and download Original Works, including access to all existing resources in the TTM library, for a subscription fee. District User: District users can create up to two thousand five hundred (2,500) Original Works, and have access to view and download all existing resources in the TTM library, for a subscription fee paid by their school district.
A. TTM reserves the right to modify these Terms of Use at any time without prior notice by posting such modifications on TTM. By continuing to use TTM after such modifications have been posted, Users indicate their agreement to be bound by these Terms of Use as modified. B. TTM, and information and services provided on and through the TTM website, are AI-generated and are provided on an 'As Is' basis. By agreeing to these Terms of Use, you agree that TTM exclusively reserves the right to modify or discontinue the provision of TTM and its services, and to modify or delete any information provided to TTM, either temporarily or permanently. TTM shall have no responsibility nor liability for the timeliness, deletion, failure to store, inaccuracy, or improper delivery of any information.
A. TTM Website: Any text, design, graphics, photos, code, and software used or incorporated into the TTM website for use in hosting and/or administering the website is the proprietary intellectual property of TTM and is governed by these Terms of Use ("Website Intellectual Property"). Users agree and acknowledge that they shall not copy, modify, create a derivative work from, reverse engineer, reverse assemble, or otherwise attempt to discover any source code, or otherwise gain any right in or access to any Website Intellectual Property, or any part thereof, at any time for any reason whatsoever. Any unauthorized use of TTM's Website Intellectual Property will be considered a violation of TTM's rights and may result in legal consequences for the party in breach. For clarity, TTM's Website Intellectual Property relates to any and all intellectual property used by the TTM, directly or indirectly, for the hosting and/or administration of the TTM website (e.g., website content) and does not include any Personal Information, Data, Original Works, Derivative Works, or any other information contributed by Users. Unless otherwise expressly agreed upon, TTM shall not, at any time, own or have any proprietary rights in any Personal Information or Derivative Works created by a User. B. Original Works: All works, including Original Works, generated through the TTM website are the proprietary intellectual property of TTM and governed by these Terms of Use ("TTM Intellectual Property"). TTM shall at all times remain the owner of TTM Intellectual Property. Upon receipt of the prescribed Fee, and subject to unconditional acceptance and compliance with the Terms of Use, TTM shall grant to the User a non-exclusive, non-transferable, revocable license to use the relevant TTM Intellectual Property, and to create Derivative Works therefrom. For clarity, a TTM account grants Users the right to generate, download, use, display, and create Derivate Works from Original Work(s) but does not transfer any intellectual property rights in the Original Work to the User.
A. Users request, access, and use TTM Intellectual Property at their own risk. Neither TTM, nor any of its affiliates, bear any responsibility nor liability for any injury of any type which Users may sustain from requesting, accessing, or using Original Works generated by TTM. B. TTM does not endorse any Derivative Work created from any of the Original Work within TTM. TTM, and its affiliates, prohibits the unauthorized use of any TTM Intellectual Property by any Derivative Work which is constructed using TTM Intellectual Property through the use of TTM databases. C. TTM makes no representations, guarantees, conditions, or warranties as to the quality, value, or uses of the TTM Intellectual Property contained on its databases, except as dictated by these Terms of Use. D. DISCLAIMER: To the fullest extent permitted by law, TTM, its officers, directors, employees, and agents disclaim all warranties, express or implied, in connection with the services and use thereof. TTM makes no warranties or representations about the accuracy or completeness of any content, information, or TTM Intellectual Property, or the content linked to TTM's Website Intellectual Property. TTM assumes no liability or responsibility for any errors, mistakes, or inaccuracies of content, information, or Original Works stored on TTM. TTM also assumes no liability for any unauthorized access to or use of TTM, and/or any Personal Information stored therein. TTM does not warrant, endorse, guarantee, or assume responsibility for any product or service advertised or offered through TTM by any third parties, nor does it warrant, endorse, guarantee, or assume responsibility for any hyperlinked services. TTM will attempt to maintain the integrity of content, Personal Information, and Original Works stored on TTM to the fullest extent possible, but TTM is not responsible for any breach or system failure of TTM, nor for any unintended disclosure of any content stored on TTM. E. LIMITATION OF LIABILITY: To the fullest extent permitted by law, TTM, its officers, directors, employees, and agents shall not be liable to Users for any direct, indirect, incidental, special, punitive, or consequential damages whatsoever resulting from any (i) errors, mistakes, or inaccuracies of content, (ii) unauthorized access to or use of TTM and any Personal Information stored therein, (iii) any interruption or cessation of transmission to or from TTM, (iv) any bugs, viruses, Trojan horses, or the like which may be transmitted to or through TTM, and/or (v) any errors or omissions in any content or for any loss or damage of any kind incurred as a result of the use of any content posted, emailed, transmitted, or otherwise made available through TTM. F. INDEMNITY: Users agree to indemnify and hold TTM, its officers, directors, employees, and agents harmless from and against any claims, causes of action, damages, losses, liabilities, fines, penalties, and expenses, including reasonable legal fees, arising out of or relating to: (i) User's violation of these Terms of Use, (ii) User's use of TTM Intellectual Property, or (iii) any content created, produced, downloaded, or otherwise made available through TTM.
