Privacy Policy

At Teacher Time Machine Inc. ("TTM", "we" or "us") your privacy is important to us. This privacy policy, as amended from time to time (this "Privacy Policy") relates to TTM’s websites, both https://teachertimemachine.com/ and https://new.teachertimemachine.com, together with the related services and content provided by TTM (collectively, the "Teacher Time Machine") that allows users to generate and share curriculum aligned teaching resources ("TTM Resources") using the TTM suite of AI powered tools. This Privacy Policy describes the personal information that we collect and explains how we use, store, process, disclose and protect that information when you use Teacher Time Machine. Please review this Privacy Policy carefully. By accessing or using the Teacher Time Machine, you are accepting and consenting to the practices described in this privacy policy. If you do not agree to this Privacy Policy, do not use the Teacher Time Machine.

For the purposes of this Privacy Policy, "personal information" refers to any information about an identifiable individual, other than the person’s business title or business contact information when used or disclosed for the purpose of business communications.

When you access or use the Teacher Time Machine with an account, we collect a variety of personal information that you submit voluntarily to us through your use of the Teacher Time Machine, including:

• your name and email address;
• payment information, invoice amounts and payment status; and
• any other personal information you submit to us in connection with creating TTM Resources including, without limitation, personal information contained files you upload from your Google Drive; provide, however, that you are prohibited from entering any student data as the purpose of Teacher Time Machine is to support educators only with the generation of curriculum aligned resources.

We also collect certain information automatically when you access or use the Teacher Time Machine, with or without an account. This information includes, but is not limited to, information about (i) your device or computer you use to connect to Teacher Time Machine such as the internet protocol address (IP address) used to access the Teacher Time Machine and your device or computer’s type of operating system, browser type and general geographic location, and (ii) your online activity such as time and duration on the Teacher Time Machine and page requests as well as how you interact with pages including, without limitation, sign-in activity and use of AI tools.

TTM uses "cookies," or similar technologies. Cookies are data files placed onto your device or computer from which you access the Teacher Time Machine and often include an anonymous unique identifier. The cookies act as an identification card and thereby allows your device or computer to be recognized each time you access the Teacher Time Machine, and records geolocation, the date and time on the Teacher Time Machine and the type of browser.

We currently use certain third-party service providers that use strictly necessary cookies, which are required for the essential operation of the Teacher Time Machine such as to authenticate you and prevent fraudulent use.

We currently also use third-party service providers that use cookies and their own tracking technologies to help us: (i) gather and analyze information about the areas visited on the Teacher Time Machine (such as the pages most read, time spent, search terms, and other engagement data) including through the collection of de-identified session replays by using analytical/performance based cookies; and (ii) recognize when you return to the Teacher Time Machine and personalize our content for you by using functional cookies. Cookies may provide us and our third-party service providers with information that we will use to evaluate, improve and personalize the user experience of the Teacher Time Machine.

You can block cookies by activating the setting on your browser that allows you to refuse the setting of all or some cookies. However, if you use your browser settings to block all cookies (including strictly necessary cookies) you may not be able to access all or parts of the Teacher Time Machine. Alternatively, you may select the type of cookies to allow and can change your preferences at any time by clicking on the consent banner to allow and change your preferences at any time. However, please note that certain third-party service providers may also use cookies, over which we have no control, which are likely to be analytical/performance cookies.

We use the personal information identified above for the purpose of operating, managing, maintaining and improving our operations relating to the Teacher Time Machine, which includes:

• providing you with access to and use of the features and functionality of Teacher Time Machine and to perform all of our other obligations and exercise our rights under the terms of service of TTM (the "Terms of Service");
• monitoring the performance of, and performing quality control activities with respect to, the Teacher Time Machine;
• helping us manage, maintain and improve our operations relating to the Teacher Time Machine by requesting, obtaining and publishing (i) comments, suggestions and feedback and (ii) testimonials;
• evaluating, improving and personalizing the user experience of the Teacher Time Machine;
• where you have opted in to receiving marketing communications, sending you news, offers and information about TTM products, services, community and professional-learning content unless and until you withdraw your consent to receive marketing communications by contacting our Privacy Officer or using the unsubscribe mechanism in any marketing email;
• protecting the data collected, stored or otherwise processed by the Teacher Time Machine by, among other things, monitoring, detecting, investigating and remedying any suspected or actual breaches of our Terms of Service, this Privacy Policy or any of our policies and procedures relating thereto;
• giving notice of any data security breaches or legal proceedings;
• giving notice of any changes to this Privacy Policy; and
• any other reasonable purpose for which consent is obtained.

In addition, from time to time, we use personal information that you submit to us to create derivative data that is aggregated and de-identified (i.e., data that cannot identify you as an identifiable individual) ("Anonymized Content"). All Anonymized Content is and shall be owned by TTM.

To help us operate, manage, maintain and improve the Teacher Time Machine as aforesaid, we may use third-party service providers to, among other things, host components of the Teacher Time Machine, store data, provide back-up services, supply content, process content to generating TTM Resources, provide transactional email delivery, manage support requests, obtain and manage customer feedback and bug reports, schedule product demonstrations, and provide payment processing services.

Third-party service providers may only use personal information to the extent required to perform their designated functions and in accordance with applicable law. In addition, we require that their respective privacy and security standards adhere to this Privacy Policy and applicable Canadian privacy legislation. The core function of the Teacher Time Machine is to generate TTM Resources using AI-powered tools. When you use a creation tool, the information you enter into that tool (such as topics, themes, instructions and other free-text input) and any files you attach are transmitted to our servers and processed by third-party AI service providers on our behalf in order to generate the requested TTM Resource. This content is processed only for the purpose of generating your TTM Resources and operating the Teacher Time Machine.

We may disclose the personal information identified above as follows:

• to our directors, officers, employees, independent contractors, affiliates and other parties who require this information to assist us with fulfilling the purposes described in this Privacy Policy;
• if your account is associated with a school or district organization on the Teacher Time Machine (for example, because your school or district purchased access for you or invited you), to the authorized administrators of that school or district, who are able to view your name, email address, role and title, sign-in activity, and statistics about your use of the TTM tools (including AI token usage);
• if you choose to share a TTM Resource or template to the Teacher Time Machine shared library or with other users, only the resource title, resource type and date of creation are shared with other users of Teacher Time Machine.
• to third-party service providers described in this Privacy Policy;
• as permitted or required by applicable law or regulatory requirements;
• when required to comply with valid legal processes such as search warrants, subpoenas, court orders or other legally valid inquiries or orders;
• during emergency situations or where necessary to protect the safety of a person or group of persons; and
• for any additional purposes for which we have obtained your consent to the use or disclosure of your personal information.

TTM and its third-party service providers may use or disclose your personal information without your knowledge or consent where we are permitted or required by applicable law or regulatory requirements to do so. In particular, TTM and its third-party service providers may disclose personal information referred to herein in response to a search warrant, subpoenas, court orders or other legally valid inquiry or order (which may include lawful access by governmental authorities, courts or law enforcement agencies), to other organizations in the case of investigating a breach of an agreement or contravention of law or detecting, suppressing or preventing fraud, or as otherwise required or permitted by applicable laws.

In addition, we may disclose or otherwise transfer personal information to another party in connection with a prospective or completed business transaction, including an asset or share sale, merger, amalgamation, plan of arrangement or some other form of business combination (including transfers made as part of insolvency or bankruptcy proceeding) involving any of TTM’s assets or shares or as part of a corporate reorganization or other change in corporate control; provided, however, that such party is bound by appropriate agreements or obligations and required to use or disclose the personal information in a manner consistent with the use and disclosure provisions of this Privacy Policy.

Access to Google User Data. The Teacher Time Machine accesses your Google Drive to upload DOCX, XLSX, PPTX, PDF, PNG, JPEG, MP4, and ZIP files. This access is limited to the specific files you choose to upload, and the specific folders you create for the purpose of uploading aforementioned files. We will always request your explicit consent before accessing your Google Drive. You have the right to revoke this access at any time through your Google account settings.

Use of Google User Data. We do not read, modify, or analyze any other files or data within your Google Drive other than the files you choose to upload to your Teacher Time Machine account.

Storage of Google User Data. The Google Drive files you choose to upload are stored both in your Google Drive and on our secure servers. Additionally, we store your Google access and refresh tokens securely on our servers to maintain your authenticated session and facilitate seamless access to your Google Drive.

Security of Google User Data. We are committed to ensuring the security of your data. Our application uses OAuth 2.0 for secure authentication and access to your Google Drive. Access and refresh tokens, as well as the files stored on our servers, are encrypted and stored securely to protect your privacy.

We are headquartered in Canada and may use third-party service providers that operate in other countries. As a result, your personal information may be processed outside of Canada in a jurisdiction with different privacy laws that may or may not be as comprehensive as Canadian law. In these circumstances, the governments, courts, law enforcement or regulatory agencies of that jurisdiction may be able to obtain access to your personal information through the laws of that jurisdiction. Whenever we engage a service provider, we require that its privacy and security standards adhere to this policy and applicable Canadian privacy legislation.

TTM is committed to protecting Personal Information collected from you against loss, misuse, unauthorized access, collection, use, disclosure, copying, modification, disposal or destruction. We use security measures including AES-256 encryption at rest, secure protocols in transit, strict access controls, secure development practices, monitoring, logging, managed infrastructure, and daily backups. We are actively pursuing SOC 2 compliance to further strengthen our controls and demonstrate our commitment to security. However, TTM cannot prevent all possible improper or unauthorized access, collection, use, disclosure, copying, modification, disposal or destruction of personal information and, subject to applicable laws, will not be responsible for any damages or liabilities relating thereto.

Should any security breaches be identified, TTM will, without unreasonable delay, assess whether the breach creates a real risk of significant harm to affected individuals and, where required by applicable law, notify the Alberta Information and Privacy Commissioner, the federal Privacy Commissioner of Canada, and affected individuals, as applicable. Any concerns of data breach or data inquiries should be immediately directed to our Privacy Officer for further investigation.

It is important to us that we collect, use or disclose personal information where we have consent to do so. Depending on the sensitivity of the personal information, consent may be implied, deemed (using an opt-out mechanism) or express. Express consent can be given orally, electronically or in writing. Implied consent is consent that can reasonably be inferred from an action or inaction.

We assume that an individual has consented to our reasonable collection and use of personal information consistent with the purposes for which the information was given, when the individual initiates contact with us or voluntarily provides personal information to us.

If you provide us with personal information about another individual, we rely on you to obtain all necessary consents to permit us to collect, use and disclose the personal information for the purposes for which the information was collected and as set out in this Privacy Policy. Notwithstanding the generality of the foregoing, you are prohibited from entering any student data as the purpose of Teacher Time Machine is to support educators only with the generation of curriculum aligned resources.

You may change or withdraw your consent at any time by contacting our Privacy Officer at the email address set out at the end of this Privacy Policy, subject to legal or contractual obligations. However, it is important to note that we may not be able to destroy or alter our archival/backup data, or secure the removal of personal information where it has been disseminated or used by third-parties.

All communications with respect to the withdrawal or variation of consent should be in writing and addressed to our Privacy Officer.

TTM retains your personal information as required to provide access to and use of the Teacher Time Machine for as long as your account is open and to comply with applicable laws. If you choose to delete your account, we will remove all stored tokens and associated data from our servers. The files stored on our servers will also be deleted upon your request or account deletion.

Subject to certain limited exceptions prescribed by law, you may submit a request to access, update or correct your personal information under the custody or control of TTM. To review, verify or correct your personal information, please submit a written request to our Privacy Officer.

When making any such request, please note that we may request specific information to enable us to confirm your identity and determine whether you have the right to access, update or correct the personal information relating to such request. Each such request will be responded to as accurately and completely as reasonably possible.

The right to access the personal information that we hold about you is not absolute. There are instances where applicable law or regulatory requirements allow or require us to refuse to provide some or all of the personal information that we hold about you. In addition, your personal information may have been destroyed, erased or made anonymous in accordance with our record retention obligations and practices. In the event that we cannot provide you with access to your personal information, we will endeavor to inform you of the reasons why, subject to any legal or regulatory restrictions.

We may charge a fee to access personal information; however, we will advise you of any fee in advance. If you require assistance in preparing your request, please contact our Privacy Officer.

TTM is committed to protecting the privacy and security of personal information in accordance with applicable privacy laws. As a private-sector organization, TTM’s collection, use and disclosure of personal information is governed by the Personal Information Protection Act (Alberta) ("PIPA") and, where applicable, the Personal Information Protection and Electronic Documents Act (Canada) ("PIPEDA"). We collect, use and disclose personal information only for purposes that are reasonable and necessary to provide our services and as authorized by law.

Where the Teacher Time Machine is made available to users through a public body, such as a school board, that public body’s collection, use and disclosure of personal information is governed by the Access to Information Act (Alberta) and the Protection of Privacy Act (Alberta), which replaced the former Freedom of Information and Protection of Privacy Act (Alberta). In those circumstances, TTM processes personal information on behalf of the public body in accordance with those statutes and our agreements with the public body. The Family Educational Rights and Privacy Act in the United States does not currently apply to the Teacher Time Machine as TTM is not a student facing platform and students and/or anyone under the age of 18 are prohibited from accessing the platform as per our Terms of Service. In limited circumstances where a student may view or interact with the platform, they must do so using an adult’s account, only with that adult’s express permission, and under direct adult supervision at all times. In such cases, TTM does not collect any personal information directly from the student, and the supervising adult remains solely responsible for any personal information entered.

The Teacher Time Machine is not directed at persons under 18 and we do not intend to collect personal information from children under 18 in our capacity as a controller. If you become aware that a child has provided us with personal information without appropriate consent, then please contact us using the details below so that we can take the appropriate steps in accordance with our legal obligations and this Privacy Policy.

TTM may, from time to time, contain links to and from third party websites. If you follow a link to any of these websites, please note that these websites have their own privacy policies and that we do not accept any responsibility or liability for their policies. Please check the individual policies before you submit any information to those websites.

In particular, we would note that any information collected for the purposes of processing payments is currently processed through third party payment software, which is governed by the terms and conditions and the privacy policies associated with such third party payment software used for the transaction, which is currently Stripe.

If you have any questions about this Privacy Policy or concerns about how we manage personal information, please contact our Privacy Officer. We will endeavor to answer your questions and advise you of any steps taken to address the issues raised by you. If you are dissatisfied with our response, you may be entitled to make a written submission to the Privacy Commissioner responsible for your jurisdiction.

We may amend this Privacy Policy from time to time in order to reflect changes in our legal or regulatory obligations or in the manner in which we deal with personal information. We will post any amended version of this Privacy Policy on the Teacher Time Machine and will use reasonable efforts to notify you of any material changes prior to the amendment becoming effective.

Any interpretation associated with this Privacy Policy will be made by our Privacy Officer. This Privacy Policy includes examples but is not intended to be restricted in its application to such examples; therefore, where the word "including" is used, it shall mean "including without limitation".

This Privacy Policy does not create or confer upon any individual any rights or impose upon TTM any rights or obligations outside of, or in addition to, any rights or obligations imposed by Canada’s federal and provincial privacy laws, as applicable. Should there be, in a specific case, any inconsistency between this Privacy Policy and Canada’s federal and provincial privacy laws, as applicable, this Privacy Policy shall be interpreted, in respect of that case, to give effect to, and comply with, such privacy laws.
